Definitions

All the words and expressions defined shall have the following meanings assigned to them, except the context requires otherwise:

1. Owner is owner of the web site www.999.ae.
2. Server is all cyberspace (database, modules and algorithms, services etc.) of the web site www.999.ae.
3. User is any juridical person (company) and individual person registered on the Server.
4. User Account (User's personal page) is Server partition available for a User after being registered on the Server, wherewith User can manage all placed Content, Content promoting and can perform other available actions on the Server.
5. Administration (Administration of the Server) are the persons, authorized by the Owner for  maintenance, moderation and other type of the procedures on the Server. Administration is acting on behalf of the Owner.
6. Content is any type of information posted by a User on the Server (such as any news, articles, messages, text, files, images, photos or any other material).
7. Posting (Content posting) is placing of content by User on the Server.
8. Promoting (Content promoting) is Content highlighting, attractiveness boost, draw attention and other procedures to promote the Content on the Server.
   
9. Moderation (Content moderation) is the process of checking and analyzing performed by the Administration of the posted content.
10. Services are all kind of the services (including paid and free of charge) available on the Server.
11. Photo slider (Hot Ads partition) is part of  the Server web page (left top corner) with changeable photos of the User Contents.
12. Content listing is part of the Server web page with the list (table) of the recent User Contents.

1. General Provisions

 You agree and accept the below Terms and Conditions at registration and use of the Server .

1. Posting of the ads, offers and tenders is available only for Users (company). For Users (individual person) is available only ads posting.
   
2. All Contents shall be passed thru Moderation. In case of mismatching with  the present Terms and Conditions, Content will be blocked and inaccessible for viewing, also can be applied Article 1(8) of the present Terms and Conditions.
3. The Content, transmitted through or linked to the Server is the full responsibility of those foriginated this information. The Administration is not responsible for any posted Content. The Administration reserves the right to refuse, move or delete any Content on the Server.
4. The Administration is not liable, in any circumstances, for any possible damages or losses incurred from Content available on the Server. The Administration is not liable, in any circumstances, for any damages or losses incurred from maintenance, use of the web site name 999 (like telephone number, number of the license car plate, etc.), use or impossibility of use of the Server and Services.
5. All Contents are property of the www.999.ae and can not be reproduced and used by third parties without writing notice from the  Administration side.
6. Administration has right to change/update the present Terms and Conditions. In case of paid Services, Administration is obliged to inform of any further changes/updates within 5 calendar days before its coming into effect.
7. All Content shall be in English only and used in Latin letters. This rule is necessary in order to evict any violation of the present Terms and Conditions and to save the Moderation time.
8. Users violate the present Terms and Conditions will have their Contents blocked/removed and may have their accounts suspended for 10 (ten) calendar days. Twice suspended, an account will not be re-activated and will be removed with all its Contents. All  the above mentioned procedures can be applied at Administration's decision without any notice and any reason definition.
9. The Content shall be activated within 60 (sixty) calendar days from date of posting upon re-activation. After 3 (three) month of non-activation, Content  shall be completely removed from the Server.
10. The total maximum number of Contents on the Server (activated and non-activated) is 999 (nine hundred ninety nine) for each User. Posting of the same Content more than twice and the same Content of other Users is STRICTLY FORBIDDEN .
11. The title of Content should correspond to its internal containing information. The Content should correspond exactly to category of posting and to transaction type.
12. It is STRICTLY FORBIDDEN the posting of the following Content:

• That falls under the Prohibited Content Categories of the UAE's Internet Access Management Policy.
• That is false, deceptive, inaccurate or misleading;
• Fraudulent or involve the sale of counterfeit or stolen items;
• Infringe any patents, intellectual property rights or copyrights, trade secret or other proprietary rights or rights of publicity or privacy;
• Unlawful, harmful, threatening, abusive, defamatory, libelous, invasive or any information harmful to minors;
• Political meeting, public manifestations, any seditions, appeal to violence, to revolution or state/military coup.
• Is of a political nature and/or is critical of any government or municipal employee of the United Arab Emirates (UAE).
• Abusive language and expressions;
• Discredits reputation, honor and virtue abasement of the any person or company. Slander and insult of the any person. Impersonates another person like political or public figures.
• Pornographic or any kind of nudity, sexually explicit or perverse content;
• Racist or discriminatory content towards any race, religion, creed, nationality, gender or any other grouping of individuals;
• Includes ID or contact information on any person/Company/Organization without permission, any information disclosure about their private life and activity;
• Includes practically useless information, that can be classified as: spam, junk mail, chain letters, pyramid schemes, or any unsolicited commercial advertisement;
• Solicitation not in the designated area or emailed to a user of the Server who did not wish to be contacted;
• Includes links to other Internet resources unless it is: (1) with expressed written permission of the Administration and  (2) in the designated area for services;
• That advertises the sale of anything illegal under the laws of the UAE;
• That contains software viruses or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
• That disrupts the normal flow with an excessive number of messages;
• That uses irrelevant and misleading contact details to disguise the origin.
• Directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable UAE law, rule, regulation or guideline for the time being in force. Without prejudice to the generality of the above, Administration does not permit transactions in the following items:

a.   Shares, bonds, debentures, etc. and/or any other financial instruments/assets of any description.

b.   Living, dead creatures and/or the whole or any part of any animal which has been kept or preserved by any means whether artificial or natural including rugs, skins, specimens of animals, antlers, horns, hair, feathers, nails, teeth, musk, eggs, nests, other animal products of any description the sale and purchase of which is prevented or restricted in any manner by applicable laws.

c.   Weapons of any description, explosion, flammable and radiation materials, military equipment and items.

d.   Alcohol, tobacco products, drugs, psychotropic substances, narcotics, intoxicants of any description, medicines, palliative/curative substances.

e.   Religious items, including books, artifacts, etc. of any description or any other such item which is likely to affect the religious sentiments of any person.

f.    "Antiquities" and "Art Treasures" as detailed in the local laws pertaining to antiquities and National Treasures.

13. It is STRICTLY FORBIDDEN:

• To provide without Administration permission, by the third parties, intermediary Services (like posting, promoting, etc.) available on the Server;
• To collect (manual or automatically) any User personal/contact information and their Content for further data processing for commercial or unlawful purposes;
• To register User account of other persons and companies;
• To register User account more than once by the same persons and companies;
• To execute some actions, directed to destabilization of the Server functionality (network attack), to attempt to gain unauthorized access to manage the Server and his partitions, or to access User accounts on the Server;
• Any other actions, which can violate the any property rights of the www.999.ae and Users.

2. Fees and charges policy

 All posted Contents are free of charge.

1. Content promoting, as a part of Services, shall be paid for by the originator of the content, according to the present fees and charges.
2. If any paid Services applicable to Content, which violates the present Terms and Conditions stipulations, the Administration may remove the Content and ban the originator of the Content without warning or refund.
3. Users of Monthly Billing Accounts shall be in charge according to signed Agreement.
4. Users of  Promoting Services (via SMS) shall pay ONLY 10 (ten) dirhams per 1 SMS for:

Bronze status (Colored content) - the font of the promoted Content shall be colored and easy separated in the Content listing on the screen. Activation period: 10 calendar days from the moment of payment.

Silver status (Top list content) - promoted Content shall be in the first rows of the Content listing, search and filter results. Activation period: 5 calendar days from the moment of payment.

Gold status - the main photo of the promoted Content shall appear on the Photo slider in the category, where Content is posted. Activation period: 2 calendar days from the moment of payment.

Note: Content, which has simultaneously all above mentioned statuses (has gold, silver and bronze status) shall obtain the VIP status and shall appear on the Photo slider on the main page of the Server, search results page and on the company directory page. The day of SMS message delivery is not included in the activation period of the status.

6. All SMS messages should contain the only Content number and Content status and nothing else (no spaces, no other characters or symbols). The Server automatically checks Content number and assigns the  selected status.
   
7. The maximum time period of the SMS processing is one hour, starting from the moment of the SMS message delivery.
   
8. All paid Services via SMS are allowed only for Etisalat subscribers.
   
9. All SMS messages sent with mistakes or mismatched to above mentioned requirements shall be charged as per Article 2(4) and shall have no effect of promoting and no refund. All such payments shall be transferred for charity purposes.
10. In the case of any problems occured during the using of the SMS, please send your requests to support@999.ae.

3. Arbitration

If any dispute arises between you and 999.ae during your use of the Server, Services or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of the present Terms and Conditions, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by 999.ae. The place of arbitration shall be Dubai. The Local Arbitration & Conciliation laws; shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language.
